Digital Millennium Copyright Act (DMCA)

Shards.lol complies with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

Filing a DMCA Notice

If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please provide us with the following information:

Required Information for DMCA Notice

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Contact information including name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  • A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed in error, you may file a counter-notification. To be effective, your counter-notification must include:

Required Information for Counter-Notification

  • Your physical or electronic signature
  • Identification of the material that was removed and the location where it appeared
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement consenting to the jurisdiction of the federal court in your district

Our Response to DMCA Notices

Valid DMCA Notice

Upon receipt of a valid DMCA notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the material of the removal
  • Provide the user with a copy of the DMCA notice
  • Inform the user of their right to file a counter-notification

Counter-Notification

If we receive a valid counter-notification:

  • We will forward the counter-notification to the original complainant
  • We will restore the material after 10 business days unless we receive notice of legal action
  • The original complainant has 10 business days to file a court action

Repeat Infringers

In accordance with the DMCA and other applicable laws, Shards.lol has adopted a policy of terminating, in appropriate circumstances, users who are repeat infringers. We may also limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

False Claims

Important Notice

Any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.
